Why does Olam Orchards have no insolvency record nine days before its winding-up hearing?

Run a counterparty through an insolvency screen. Nothing comes back, so you move on. That is what the screen is for, and it is not wrong.

At 10:30am on 12 August, the Supreme Court of Victoria hears an application to wind up Olam Orchards Australia Pty Ltd. Run the screen at 10:29 that morning and, unless an appointment has been made in the meantime, it will still show nothing.

The reason is narrow and worth knowing. No insolvency practitioner has been appointed to Olam, so a check built to return appointments has nothing to return, and will not unless an appointment is made, whether by the company, a secured creditor or the court. The company is registered. Its ABN and GST registrations are active. ASIC's published notices record no external-administration appointment against ACN 139 442 532.

What was published, on 3 August, is the application itself: PGP Group (Aust) Pty Ltd commenced it on 26 June, and the notice carries the court, the hearing and file S ECI 2026 04176.

Scale is the part that makes the gap matter. Olam Orchards reported A$583.3 million of total income for 2023-24, its tenth appearance in the ATO's corporate-transparency file. Total income is a historical scale marker, not profit, valuation or its position today.

Then the direction of the action. The applicant, PGP Group, is itself subject to a deed of company arrangement, with administrations recorded against its ACN in October 2023 and October 2024, each followed by a deed. That history says nothing about whether its claim is good. It does show why a label such as applicant or respondent cannot stand in for reading the record.

The distinction is not academic and it runs both ways. An application seeks a court order. It is not an appointment, a court finding, or proof that a debt is due, and the notice states no basis or merits.

So the practical answer to the opening question: an appointment screen answers "has someone been appointed", and for Olam the honest answer is no. It cannot answer "is this counterparty in court next week". On 3 August those two questions produced different answers, and only one of them was being asked.

The ABR records the business name Tesla Concrete; the company register records former name Catalyst Construction & Building Services Pty Ltd. Rent4Keeps completed the move from administration to liquidation. One filing covers five Rent4Keeps entities, including the national franchisor and operations trading under the brand in NSW, Queensland, Victoria and Western Australia. Sam Kaso and Matthew Sweeny were appointed administrators on 24 April; the 3 August filing records liquidation commencement on 31 July.
